Under the ruling, a buyer building a modular home may fall into one of two categories.

If the contract covers the construction and completion of the home in a comprehensive way, including delivery and installation, the buyer is generally treated the same as someone building a traditional home under a standard building contract.

If the buyer instead manages multiple contracts or takes responsibility for coordinating key stages of the build, they may be considered an owner builder. In this case, the timing and process for applying for the First Home Owner Grant can be different.
